Terms & Conditions - Property Viewing Service
1. Definitions
“We / Us / Our” means the Property Agent or Company providing the Property Viewing Service.
“Client / You” means the buyer or prospective buyer engaging the Service.
“Property” means the residential or commercial property to be viewed.
“Service” means the property viewing, inspection of common parts (where applicable), review of provided title documents, and provision of feedback and observations as described in these Terms.
“Report” means any written, verbal, photographic, video, or recorded feedback provided following the viewing.
2. Scope of the Service
2.1 The Service is designed to assist Clients who are unable to view a Property in person or who require support in carrying out preliminary due diligence prior to making an offer.
2.2 The Service may include:
Attending the Property viewing on the Client’s behalf;
Visual inspection of the Property’s internal conditions;
Visual inspection of external areas and common parts (where access is available);
General observations on apparent condition, layout, finishes, and maintenance;
General observations of the surrounding neighbourhood, based on our visit at the time of viewing (including factors such as nearby amenities, transport links, general atmosphere, and observable land use);
Taking photographs and/or video recordings of the Property, common areas, and the surrounding areas (where permitted and agreed in advance);
Review of title documents and property-related documentation provided by the Client or selling party;
Providing a factual and opinion-based Report based on observations made at the time of viewing.
2.3 The Service does not include any form of valuation, survey, structural inspection, compliance check, environmental assessment, or legal advice.
3. Limitations of the Service
3.1 The Service is not a substitute for:
A professional building or structural survey;
Specialist inspections (e.g. electrical, plumbing, fire safety, damp, asbestos);
Legal advice or conveyancing services.
3.2 Any comments made regarding condition are based solely on a non-invasive, visual inspection and do not involve lifting flooring, opening walls, testing services, or accessing restricted areas.
3.3 We do not guarantee the completeness, accuracy, or future reliability of information obtained from third parties, managing agents, sellers, or documents supplied to us.
3.4 The Client acknowledges that property condition may change after the viewing date.
4. Title Document Review
4.1 Where agreed, we may review title documents, lease summaries, or related paperwork provided to us.
4.2 This review is limited to identifying general observations, apparent issues, or points for further investigation.
4.3 We do not provide legal interpretation, advice, or confirmation of title validity, boundaries, rights, restrictions, or obligations.
4.4 Clients are strongly advised to instruct a qualified conveyancer or solicitor for full legal due diligence.
5. No Advice Disclaimer
5.1 Any opinions expressed in the Report are provided in good faith and represent our personal, professional observations only.
5.2 Nothing in the Service or Report shall be relied upon as legal, financial, surveying, or investment advice.
6. Client Responsibilities
6.1 The Client is responsible for:
Providing accurate instructions and Property details;
Confirming access arrangements where required;
Supplying any documents they wish us to review;
Making their own decision on whether to proceed with an offer or purchase.
6.2 The Client remains solely responsible for instructing appropriate professionals prior to exchange or completion.
7. Fees and Payment
7.1 Fees for the Service will be agreed in advance and confirmed in writing.
7.2 Payment must be made in accordance with the agreed terms and is non-refundable once the viewing has taken place.
7.3 Additional fees may apply for extended viewings, additional Properties, urgent instructions, or additional document review.
8. Liability
8.1. The Company shall not be liable for any loss, damage, or expense incurred by the Client as a result of the Client’s decision based on the Report or any issues relating to the condition of the property, legal defects, or third-party delays.
8.2. The Client agrees to indemnify and hold the Company harmless from any claims, liabilities, or costs arising out of actions taken on behalf of the Client in good faith.
9. Use of Reports
9.1 The Report is provided solely for the Client’s personal use.
9.2 The Report may not be relied upon by any third party without our prior written consent.
10. Confidentiality & Data Protection
10.1 We will treat all Client information as confidential and handle personal data in accordance with applicable data protection laws.
10.2 Reports may include photographs or videos of the Property for due diligence purposes only.
11. Cancellation
11.1 Cancellations must be made at least 24 hours prior to a viewing appointment.
11.2 We reserve the right to charge a cancellation fee, where access has been arranged or costs incurred.
12. Governing Law and Jurisdiction
12.1. This Agreement shall be governed by and construed in accordance with the laws of the United Kingdom.
12.2. Any disputes arising from or in connection with this Agreement shall be resolved through mediation or arbitration before proceeding to litigation.
13. Acceptance of Terms
By instructing us to provide the Service, the Client confirms that they have read, understood, and agreed to these Terms and Conditions.
